A Florida man was sentenced Monday to eight months in prison for his role in the Jan. 6 riots in Washington, a sentence that is likely to set a benchmark for later cases.
Paul Hodgkins of Tampa pleaded guilty to obstructing official proceedings after entering the U.S. Senate Hall during an attack on the U.S. Capitol.
Hodgkins was photographed wearing a Trump 2020 T-shirt with a flag on his shoulder and glasses around his neck and was seen taking selfies with the self-described “shaman” in a helmet with a horn and other rebels behind him.
He is the first rebel convicted of a crime in connection with the attack, in which hundreds of Trump supporters stormed the Capitol after being exposed for election fraud lies that led to Trump’s defeat by Joe Biden.
More than 570 people are accused of taking part in the riots, during and after which five people died.
Prosecutors have asked Hodgkins to serve 18 months, saying he had filed a lawsuit in court that “like any other rebel has contributed to a collective threat to democracy”, forcing lawmakers to temporarily waive confirmation of Biden’s victory and seek refuge.
Speaking in court in Washington on Monday, Hodgkins apologized and said he was ashamed of his behavior.
Reading from a prepared text, he described being caught in euphoria as he walked through Washington and then followed the crowd of hundreds to Capitol Hill and inside the Congress building.
“If I had the idea that the protest… would escalate [as] what happened… I would never have dared to go beyond the sidewalk on Pennsylvania Avenue,” Hodgkins told U.S. District Judge Randolph Moss.
He added: “It was a stupid decision on my part.”
Moss said Hodgkins “actively and deliberately” took part in an attack that threatened “democracy itself,” BuzzFeed reported. Moss also said Americans should be aware that an attack on the Capitol “will have serious consequences”.
“The court here had to take into account what I think are extremely harmful events that happened that day, but also who is Mr. “Hodgkins as an individual,” Moss said. “And, as I think it is reflected in the sentencing, I tried to strike that balance.”
Hodgkins’s sentence may affect other defendants as they decide whether to accept plea agreements or go to trial. He and others have been charged with serious crimes but have not been charged, like many others, with major conspiracy theories.
Hodgkins’s lawyer asked the judge not to impose a prison sentence, saying he would carry the shame for the rest of his life.
Hodgkins was not charged with assault or damage to property. Prosecutors said he deserved some leniency because he took responsibility almost immediately and pleaded guilty to obstruction, which carries a 20-year prison sentence.
But they also noticed him boarding a bus to his hometown of Tampa to attend a Trump rally with rope, goggles and latex bracelets in his backpack – saying it showed he had come to Washington ready for violence. (According to the agencies)
